1. Acceptance of Terms

Welcome to Voyatrix Travel ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Voyatrix Travel website, products, and services, including but not limited to custom travel itinerary design, route mapping, restaurant curation, transportation planning, and budget optimization consulting (collectively, the "Services"). By accessing our website or purchasing any of our Services, you agree to be bound by these Terms in their entirety. If you do not agree to all of the provisions set forth herein, you must discontinue use of our website and Services immediately.

These Terms constitute a legally binding agreement between you and Voyatrix Travel, a company registered and operating in the State of Colorado, United States, with its principal office located at 1680 38th St, Boulder, CO 80301. We reserve the right to update, modify, or replace any part of these Terms at our sole discretion. It is your responsibility to review these Terms periodically for changes. Your continued use of or access to our website or Services following the posting of any changes constitutes acceptance of those changes.

2. Description of Services

Voyatrix Travel provides bespoke travel itinerary design services. Our Services include, but are not limited to, the following:

• Custom day-by-day and hour-by-hour travel itineraries designed around your preferences, interests, pace, and travel style.
• Curated selection of attractions, landmarks, cultural experiences, and hidden gems at your chosen destination(s), personally vetted by our travel architects.
• Restaurant and dining recommendations matched to your culinary preferences, dietary restrictions, and budget, including Michelin-starred establishments and authentic local eateries.
• Detailed route maps with optimized walking paths, driving directions, and point-to-point navigation guidance.
• Comprehensive transportation schemes including flight suggestions, train schedules, ferry connections, local transit routes with specific line numbers and stop identifications.
• Budget optimization reports with strategic recommendations for allocating your travel budget across accommodations, dining, experiences, and transportation without compromising quality.
• Backup and alternative plans for inclement weather, closures, or schedule changes.

Our Services are purely consultative and informational in nature. We provide recommendations, itineraries, and planning documents. We do not directly book flights, hotels, rental cars, tours, or restaurant reservations on your behalf unless explicitly stated in a separate written agreement.

3. Eligibility

To use our Services, you must be at least 18 years of age and possess the legal authority to enter into binding agreements. By using our Services, you represent and warrant that you meet these eligibility requirements. If you are using our Services on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

4. Ordering and Payment

When you place an order for any of our itinerary design packages (Essential, Premium, or Odyssey), you agree to provide accurate, current, and complete information during the ordering process. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

All prices listed on our website are in United States Dollars (USD) unless otherwise specified. Prices are subject to change without prior notice, though any price changes will not affect orders that have already been confirmed and paid for. Payment is due in full at the time of order unless a custom payment arrangement has been agreed upon in writing.

We accept major credit cards, debit cards, and other payment methods as displayed during checkout. By submitting payment information, you authorize us to charge the applicable fees to your designated payment method. All transactions are processed securely through our payment processor, and we do not store your full credit card information on our servers.

5. Consultation and Design Process

After placing an order, you will be contacted by one of our travel architects to schedule an initial consultation. During this consultation, we will gather detailed information about your travel preferences, interests, group composition, budget parameters, dietary requirements, mobility considerations, and any specific requests. The quality and accuracy of your itinerary depends significantly on the completeness and accuracy of the information you provide during this consultation.

Following the consultation, our team will conduct thorough research and design your itinerary. Estimated delivery timelines are: 7-10 business days for Essential packages, 10-14 business days for Premium packages, and 14-21 business days for Odyssey packages. These timelines begin after the initial consultation is completed and are estimates only; actual delivery times may vary based on destination complexity, trip duration, and seasonal research requirements.

6. Revisions

Each pricing tier includes a specified number of revision rounds. The Essential package includes one (1) revision round, the Premium package includes three (3) revision rounds, and the Odyssey package includes unlimited revisions. A "revision round" is defined as a single submission of requested changes by the client, followed by implementation of those changes by our team. Each revision round typically has a turnaround time of 3-5 business days.

Additional revision rounds beyond those included in your package may be purchased separately at a rate that will be communicated to you at the time of request. Revisions must be requested within thirty (30) days of receiving your final itinerary delivery. After this period, any modifications will be treated as a new project and priced accordingly.

7. Intellectual Property

All content, itineraries, maps, guides, documents, graphics, layouts, and materials created by Voyatrix Travel as part of our Services are the intellectual property of Voyatrix Travel unless explicitly transferred in writing. Upon full payment, you are granted a non-exclusive, non-transferable, personal license to use the delivered itinerary materials for your personal travel purposes.

You may not reproduce, distribute, sell, license, publicly display, or create derivative works from our itinerary materials without our prior written consent. You may share portions of your itinerary with your travel companions for the purpose of the planned trip. The Voyatrix Travel name, logo, brand elements, and all related trademarks are the exclusive property of Voyatrix Travel and may not be used without our express written permission.

8. Accuracy and Disclaimer

While we make every reasonable effort to ensure the accuracy of our itineraries, recommendations, opening hours, prices, transit schedules, and other information, Voyatrix Travel cannot guarantee that all information will be accurate at the time of your travel. Destinations, attractions, restaurants, and transportation providers may change their hours, pricing, availability, or operations without notice.

Our itineraries are designed based on information available at the time of creation. We strongly recommend that you verify critical details such as operating hours, reservation requirements, visa requirements, health advisories, and local regulations close to your departure date. Voyatrix Travel is not liable for any inconvenience, cost, or loss arising from changes made by third parties after your itinerary has been delivered.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Voyatrix Travel, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party referenced in our itineraries; (c) any content obtained from our Services; or (d) unauthorized access, use, or alteration of your information.

Our total aggregate liability for all claims arising out of or relating to these Terms or our Services shall not exceed the amount you paid to Voyatrix Travel for the specific Service giving rise to the claim during the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Voyatrix Travel, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Services caused damage to a third party.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms or your access to or use of our Services shall be instituted exclusively in the federal or state courts located in Boulder County, Colorado. You agree to submit to the personal jurisdiction of such courts and waive any objection to the venue of any such proceeding.

12. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Voyatrix Travel regarding the use of our Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
